About Frank N. Del Giudice and FND Mediations
Experience is the difference.
Since his call to the Ontario Bar in 1998, Frank has practiced primarily in the area of civil litigation with an emphasis on insurance and personal injury cases including:
- motor vehicle accidents (tort and accident benefits)
- transportation law
- occupiers’ liability
- municipal liability
- product liability
- property damage
More recently, Frank’s practice was focused on representing seriously injured plaintiffs, including those sustaining catastrophic impairments. He has been an Associate and Partner in private practice representing both plaintiffs and defendants, and has also had the roles of Senior Counsel and Managing Lawyer at two of Canada’s largest In-House Insurance Legal Departments. He was recently recognized by his peers and colleagues for expertise in the practice area of Personal Injury (representing plaintiffs and defendants) in the 2023 Canadian Legal Lexpert Directory.
His over 26 years of experience representing clients on both “sides” gives him a unique insight and perspective when considering the strengths and weaknesses of the involved parties’ cases — allowing him to offer creative settlement options at mediation.
In addition, Frank’s expert insight coupled with his honed communication skills and cognitive empathy, allows him to overcome challenges during the mediation process and defuse conflict.
Why mediate with FND Mediations?
As a seasoned litigator, with extensive trial experience and a number of reported and precedent-setting decisions at all levels of Court, Frank understands the inherent risks of having cases determined by a judge or a jury.
Simply stated, trials are costly and unpredictable. It is for this reason that many involved in litigation find mediation as the preferred option since the parties play an active role in resolving their disputes, while having more control over the process in a more informal (and “without prejudice”) setting.
As part of Frank’s litigation practice, he has participated in well over 900 mediations and settlement conferences as counsel for both plaintiffs and defendants, and has acted as mediator at the request of counsel on numerous mandatory and private mediations since 2016.
In addition to his practical experience with mediations and as mediator, Frank has completed courses in Alternative Dispute Resolution (ADR) at the University of Ottawa, Faculty of Law, and in 2016, he obtained a Certificate from the Faculty of Law, University of Windsor in ADR through the Stitt Feld Handy Group ADR Workshop. His practical and varied experience in litigation and mediation in a variety of insurance-related disputes coupled with his advanced mediation training gives Frank the necessary skills to act as an effective mediator.
His approach as mediator is to allow counsel to advance their client’s best interest and position while maintaining a civil and collaborative environment, with the ultimate goal of resolving the case fairly and reasonably.
